Jamie Foxx sued for sexual assault at NYC rooftop bar in 2015

Renowned actor and comedian Jamie Foxx is facing sexual assault allegations after a suit was filed against him on Wednesday. The suit alleges that in 2015, he sexually assaulted a patron at a rooftop bar in New York. The patron, identified in the suit as Jane Doe, alleges that in 2015 she had an encounter with Foxx in which he rubbed her breasts and put his hands under her pants without her consent in a secluded corner of the Catch NYC rooftop lounge.

According to the suit, the Woman’s friend asked Jamie Foxx, who was seated at a table next to them, for a photo around 1 a.m. on August 26, 2015, while he was seated with Mark Birnbaum, the owner of the bar. The lawsuit goes on to say that the actor appeared intoxicated and agreed to a photo, saying, “Sure, baby, anything for you.” Adding that, he told the woman she smelled “so good” and had a “supermodel body.”

Further, the suit states that Jane Doe went to a secluded section of the restaurant and touched her breasts. But when she attempted to move away, he then put his hands in her underwear and “put his fingers on and in Plaintiff’s vagina and anus.” It added that, a security guard witnessed the groping but did not intervene. And Foxx only stopped touching her when her friend came looking for her. The plantiff is alleging “sexual assault, abuse, assault, and battery” and suing Foxx for damages.

On his part, Foxx’s spokesperson denied the allegations in a statement. He said that “the alleged incident never happened.” “In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter. The claims are no more viable today than they were then. We are confident they will be dismissed again. And once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”

The legal action is one of many instituted under the New York Adult Survivors Act. An act that allows alleged victims of sex crimes to sue after the statute of limitations has lapsed.
